Beneficiary Designations
간단한 설명
A beneficiary designation directs a contract or account at death and usually controls that asset independently of the will, subject to the plan terms and governing law.
- Review primary and contingent names together
- Primary and contingent beneficiaries should be reviewed together.
- Each account type has its own rules
- Retirement plans, IRAs, insurance, annuities, and transfer-on-death accounts have different rules.
- Some beneficiaries create extra administration
- Naming minors, an estate, or a person receiving means-tested benefits can produce unintended administration or tax results.
- Divorce laws and federal rules can upset assumptions
- Divorce statutes and federal preemption can make assumptions dangerous; submit and retain accepted forms.

더 깊이 알아보기
Beneficiary forms often move more money than the will. This guide covers how primary and contingent names work, where account rules differ, and the situations that cause the most trouble.
일반적으로 검토하는 사람
Anyone with a 401(k), IRA, life insurance policy or payable-on-death account, and especially people who have divorced, remarried or had children since last updating a form.
Tax lens
Accounts that pass by beneficiary form are still part of the federal gross estate, and inherited pre-tax retirement accounts carry income tax: many non-spouse beneficiaries must empty an inherited IRA within ten years under the SECURE Act rules. Naming the estate instead of a person can shorten the payout period and send the money through probate.
흔한 실수
No contingent beneficiary
Outdated former partner
Trust named imprecisely
Will and form conflict
