The usual order of an estate administration

  1. Death & documents Secure property, obtain certificates, and locate the will and planning records.
  2. Court authority File the petition and obtain appointment where probate is required.
  3. Inventory & claims Identify, value, protect, and account for estate property and obligations.
  4. Taxes & distribution Resolve proper claims and filings before authorized distribution and closing.
A general educational sequence. A real matter can follow a different path.

Probate is the court process that gives someone authority to collect a decedent's property, pay what is owed and pass on the rest. The sections below cover what goes through it, what does not, and why the experience varies so much by state.

Executors facing a first court filing, families deciding whether an estate needs probate at all, and people weighing a living trust to keep property out of court.

Tax lens

Probate and estate tax measure different things. The federal gross estate includes nonprobate assets, such as retirement accounts and life insurance the decedent owned, so avoiding probate does not reduce estate tax. The personal representative also answers for the decedent's final income-tax return and any estate income-tax returns.
