Wie het doorgaans overweegt

Relatives left out of, or cut back in, a recent will, executors defending a will against a threatened challenge, and people making a will they expect some relatives to dispute.

Tax lens

A settlement can change who is treated as receiving property, which can affect the marital or charitable deduction and income tax. An heir who gives up a share may also need to know whether that is a qualified disclaimer under IRC § 2518 or a taxable gift.

Veelgemaakte fouten

  2. Assuming a no-contest clause always controls

What should be verified before acting?

Verify the current governing instrument, title and beneficiary records, applicable state law, current tax year, primary authority, and advice from appropriately qualified professionals.
